Flux International is not a bank, credit union, or deposit-taking institution. It does not accept deposits, does not hold client funds, and does not issue loans directly from its own balance sheet. Under US financial law, a banking charter is not required for companies that act as financial intermediaries, facilitators, or infrastructure providers between clients and licensed banking institutions — provided the company does not accept deposits or extend credit from its own funds.

Flux International operates in the same regulatory category as mortgage intermediaries, insurance intermediaries, and trade finance facilitators: companies that introduce clients to licensed financial institutions and charge a facilitation fee for the service. Client accounts and loan facilities are opened and held directly at FDIC-insured partner banking institutions, not at Flux International.

2. Compliance Framework

Flux International maintains compliance with the following regulatory frameworks:

  • Bank Secrecy Act (BSA): Customer due diligence, suspicious activity monitoring, and recordkeeping obligations maintained as a financial intermediary.
  • BSA Intermediary Compliance: As a banking infrastructure intermediary that does not hold, transmit, or convert client funds directly, Flux International operates under BSA due-diligence and recordkeeping obligations. Client currency conversions are executed by and reported through licensed partner banking institutions — not by Flux International directly.
  • OFAC Sanctions Screening: All clients and counterparties screened against OFAC SDN and consolidated sanctions lists before onboarding.
  • USA PATRIOT Act / CIP: Customer Identification Program (CIP) and Know Your Customer (KYC) procedures in place for all clients.
  • New York State LLC & Business Law: Compliance with NY State LLC operating requirements, state business registration filing obligations, and applicable New York financial service intermediary regulations.

Why No Separate MSB Registration?

FinCEN MSB registration is required for companies that directly transmit or convert funds on behalf of clients. Flux International is a banking infrastructure intermediary and facilitator: it introduces clients to licensed banking institutions and charges a flat facilitation fee. Client funds are held and converted by FDIC-insured partner banks, not by Flux International. This is the same regulatory model used by licensed mortgage brokers, insurance brokers, and trade finance facilitators. Clients are encouraged to request our entity details and verify the NY LLC registration independently.

Claims settlement funds are held in segregated accounts with FDIC-insured banking partners. Flux International does not commingle client funds with its own operating accounts.

3. Risk Disclosure

All financial services carry inherent risk. Specific disclosures applicable to Flux International global financial technology platform services:

  • Precious metals valuations are subject to market volatility. Claim settlements are based on spot-market pricing at the time of valuation lock.
  • Past claim settlement outcomes are not indicative of future results.
  • Currency conversion rates are provided at the time of transaction and are subject to market fluctuation.
  • Loan facilitation outcomes depend on the credit assessment of the partner banking institution and are not guaranteed by Flux International.
  • International wire transfers are subject to correspondent banking procedures, which may result in processing delays outside of Flux International’s control.

4. USA PATRIOT Act — Customer Identification Notice

To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account or engages services.

What this means for you: When you use Flux International’s services, we will ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver’s license or other identifying documents.

5. No Guaranteed Returns

Flux International does not guarantee any returns on investments, savings, or claim outcomes. Statements such as “competitive rates” refer to market-rate pricing at the time of transaction, not guaranteed future performance. No employee or representative of Flux International is authorised to guarantee profits or specific financial outcomes.

6. Fraud Warning & Verification

Flux International is aware that scammers sometimes impersonate legitimate financial infrastructure companies. The following verification facts are provided to help clients confirm they are dealing with the genuine Flux International entity:

7. India-Specific Regulatory Directives (RBI & TRAI Notice)

Pursuant to the directives and regulatory guidelines of the Reserve Bank of India (RBI) and the Telecom Regulatory Authority of India (TRAI), Flux International issues the following notices for clients and partners in India:

  • Digital-Only Indian Presence: Under applicable RBI guidelines, Flux International does not operate physical branches within the territory of India at this time. Services are facilitated exclusively online through our official verified domain (fluxinternational.org / bank.fluxinternational.org) and concern sub-portals.
  • Future Branch Operations: Physical branches will be established and available in India once the necessary regulatory approvals and licenses from the RBI and TRAI permit physical branch establishments.
  • TRAI SMS Sender ID Registration: To combat spam and ensure compliance with TRAI's commercial communication guidelines, Flux International has officially registered in India with TRAI under the Sender ID / SMS Header FLUXIN. All official transactional, regulatory, and administrative communications routed to clients in India will be delivered exclusively via the FLUXIN sender ID once the integration is fully implemented.

TRAI DLT SMS & Onboarding KYC Integration Guide

In compliance with TRAI's Telecom Commercial Communications Customer Preference Regulations (TCCCPR), all transactional notifications, security alerts, and KYC verification messages routed to Indian numbers must be processed through Distributed Ledger Technology (DLT) portals. Below is the onboarding verification lifecycle, mandatory API variables, and example payloads used to verify identity.

1. Mandatory DLT Registration Steps

  1. Principal Entity (PE) Registration: Register your corporate entity on an approved DLT portal (e.g., Jio, Airtel, Vi) to obtain a unique 19-digit PE ID.
  2. Header / Sender ID Approval: Submit the 6-character alphabetic header FLUXIN under the "Transactional" or "Service Implicit" category.
  3. Content Template Registration: Register explicit SMS message templates with dynamic placeholders ({#var#}) to secure 19-digit Template IDs.
  4. SMS Gateway Binding: Bind the DLT credentials (PE ID, Header ID, Template ID) with your secure SMS API gateway.
